A Homeowners’ Association is formed by a real estate developer, typically for a subdivision or condominium complex. It is usually a non-profit corporation, having a board of directors, and has to abide by corporate laws. The Association collects dues from the members to pay for the services they provide and may collect fines for those breaking the Association’s rules. The Homeowners’ Association is responsible for property and issues that are common to all the residents in a community. These usually include mowing the grass, taking care of swimming pools, clubhouses, parks and legal issues. The Association may also have broader responsibilities, such as maintaining walkways and buildings. In addition, the Homeowners’ Association typically has rules regarding what can be done with individual properties. These rules usually cover things like paint tones or what may be stored on a deck or porch and are sometimes believed to be very strict.
